Rental terms

The key terms, in plain English

This page summarises what a rental agreement with us says. It is not the agreement. The agreement you sign at pickup is the document that governs your rental; if anything here differs from it, the signed agreement applies.

Rentals are provided by OM DRIVE RENTAL (ABN 41 703 555 873), Victoria, Australia.

The basics

  • You rent the car for a minimum term shown on the car, then week to week until the planned end date in your agreement or any written extension.
  • Weekly rent is paid in advance on the payment day in your agreement. The bond is paid before or at pickup.
  • Only drivers named in the agreement may drive the car. Each must meet the licence and age requirements and sign.
  • The car may only be used for the purpose recorded in the agreement (for example personal or business use, or rideshare where the car is approved for it). Other uses are not permitted.

Your responsibilities

  • Drive lawfully and carefully, and do not let unnamed people drive.
  • Pay tolls, fines and parking incurred while you have the car. We nominate the driver to the authority as the law requires.
  • Keep the car clean and tell us promptly about faults, warning lights, damage or an accident.
  • No smoking or vaping in the car. No towing, racing, off-road driving or carrying more passengers than seats.
  • Do not take the car interstate or leave it with a third party without our written approval.
  • Return the car on time, to the agreed place, with the fuel level and condition recorded at pickup (fair wear excepted).

Our responsibilities

  • Provide a registered, roadworthy car and the servicing it needs during your rental, with cover and excess as stated in your agreement.
  • Record the car’s condition with you at pickup and return, and give you copies.
  • Refund the bond after the return inspection, less only deductions permitted by the agreement, within the period the agreement states, and give you an itemised statement of any deduction.

Insurance and damage

Cover and excess are explained in your agreement before you sign — ask us.

If the car is damaged, stolen or causes damage while you have it, what you pay for each incident, including any damage excess, is stated in your agreement. Where the loss is caused by a breach of the agreement (for example an unnamed driver, driving under the influence, or use outside the agreed purpose) you may be responsible for the full loss.

Ending the rental

  • Either party may end the rental on the notice stated in the agreement after the minimum term.
  • If you return the car before the minimum term ends, the agreement sets out whether rent for the remainder is payable.
  • We may end the rental early and recover the car if rent is unpaid, the car is misused, or the agreement is otherwise breached, after giving the notice the agreement requires.
